1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of the websites www.iet.com.sg and www.manpowersupply.sg, the mobile application [APP NAME] distributed via the Google Play Store, and any related content, features and services (together, the "Platform") operated by IET PTE LTD (UEN 201507090K), a company incorporated in Singapore with its registered address at 212 Hougang St 21, #04-345, Singapore 530212 ("IET", "we", "us" or "our"). By accessing the Platform, creating an account, downloading or using our mobile application, or submitting an enquiry through the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform. These Terms should be read together with our Privacy Policy, which forms part of these Terms.

2. Definitions

Term Meaning
Application The IET mobile application known as [APP NAME], including all updates, patches and releases.
Client A business entity that engages IET for manpower supply, labour outsourcing or related services.
Content All text, graphics, images, logos, documents, software, data and other material made available on the Platform.
Services The manpower supply, labour outsourcing, deployment support and related services provided by IET.
User Any person who accesses or uses the Platform, including Clients, Workers, candidates and visitors.
User Content Any information, document, image or material that a User uploads to or submits through the Platform.
Worker An individual supplied or deployed by IET, or registered with IET for possible deployment.
 

3. Eligibility

You must be at least [18] years of age and legally capable of entering into a binding contract to use the Platform. If you use the Platform on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity, and references to "you" include that entity. You must not use the Platform if you are barred from doing so under the laws of Singapore or any other applicable jurisdiction.

4. Our Services

IET is a manpower supply and labour outsourcing company licensed by the Ministry of Manpower. We supply workers and provide outsourced labour solutions to business clients across sectors including construction, workplace safety and health, facilities management, aviation, information technology and specialist trades. The Platform is provided as an information, enquiry and service-support channel. It is not itself a marketplace, a job board, or a contract of engagement. Any actual supply of manpower or provision of Services is governed by a separate written Service Agreement, purchase order or contract executed between IET and the Client. Descriptions of Services, sectors, roles and capabilities on the Platform are for general information. They do not constitute an offer capable of acceptance, and they may be updated, varied or withdrawn at any time.

5. No Guarantee of Engagement or Deployment

Registration on the Platform, submission of particulars, or expression of interest does not create any employment relationship, guarantee of deployment, offer of engagement, or entitlement to work of any kind. Deployment depends on Client requirements, regulatory approvals, qualification and certification checks, medical fitness, work pass eligibility and other factors outside our control. Where any employment or engagement is subsequently entered into, it will be governed by a separate written agreement and by the applicable provisions of the Employment Act 1968, the Employment of Foreign Manpower Act 1990 and all other applicable Singapore legislation.

6. Accounts and Security

Certain features may require you to register an account. When you register you agree to:
  • provide information that is accurate, current and complete, and to keep it updated;
  • keep your login credentials confidential and not share them with any other person;
  • be responsible for all activity that occurs under your account;
  • notify us immediately at contact@iet.com.sg of any unauthorised use or suspected security breach.
  We may suspend, restrict or terminate an account at any time where we reasonably believe these Terms have been breached, where required by law, or where necessary to protect the Platform or other Users. You may delete your account at any time in accordance with Section 15 of our Privacy Policy.

7. Licence to Use the Application

Subject to your compliance with these Terms, IET grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and use the Application on a device that you own or control, solely for your own lawful use in connection with our Services. This licence does not transfer any ownership. All rights not expressly granted are reserved. You must not:
  • copy, reproduce, distribute, sell, rent, lease, lend or sublicense the Application;
  • modify, adapt, translate, reverse engineer, decompile or disassemble the Application, or attempt to derive its source code, except to the extent this restriction is prohibited by law;
  • remove, obscure or alter any proprietary notice, trade mark or label;
  • use the Application on a device that has been jailbroken or rooted, or bypass any security or technical limitation;
  • create derivative works or competing products based on the Application.

8. Acceptable Use

You agree not to use the Platform to:
  • breach any applicable law, regulation, licence condition or third-party right;
  • submit false, misleading, fraudulent or impersonated information, including forged certificates, work pass documents or qualifications;
  • upload or transmit any material that is defamatory, obscene, discriminatory, harassing, threatening or otherwise objectionable;
  • introduce any virus, worm, trojan, ransomware, logic bomb or other malicious code;
  • attempt to gain unauthorised access to the Platform, our servers, or any connected system or network;
  • scrape, harvest, data-mine, crawl or use automated means to extract data from the Platform without our prior written consent;
  • interfere with, disrupt, overload or impair the operation, integrity or performance of the Platform;
  • use the Platform to send unsolicited commercial communications or to solicit our Clients, Workers or staff;
  • use the Platform for any purpose other than the purpose for which it is made available.
  Submitting falsified documents or misrepresenting identity, qualifications or immigration status may constitute an offence under Singapore law and will be reported to the relevant authorities.

9. User Content

You retain ownership of any User Content you submit. By submitting User Content you grant IET a non-exclusive, royalty-free, worldwide licence to store, reproduce, process and use that content solely for the purpose of providing our Services, complying with legal and regulatory obligations, and operating the Platform. You represent and warrant that you own or have all necessary rights and consents to submit your User Content, that it is accurate, and that it does not infringe any third-party right or breach any law. We may review, refuse, remove or delete any User Content that we reasonably consider to breach these Terms, without notice and without liability.

10. Fees

Access to the Platform is provided free of charge unless otherwise stated. Fees for our Services are set out in the relevant quotation, Service Agreement or purchase order agreed with the Client, and are payable in accordance with that document. In accordance with the Employment Agencies Act 1958 and its regulations, IET does not impose any charge on a Worker except as expressly permitted by law. Any fee lawfully chargeable will be clearly disclosed in writing in advance. [IF THE APP OFFERS PAID FEATURES, ADD PRICING, BILLING, AUTO-RENEWAL AND REFUND TERMS HERE. 11. Intellectual Property

The Platform and all Content, including the "IET" name, the "Smart Solution" tagline, logos, designs, layout, text, graphics, software, databases and their selection and arrangement, are owned by or licensed to IET and are protected by copyright, trade mark and other intellectual property laws. You may view, download and print Content for your own internal, non-commercial reference, provided you do not remove any proprietary notice. You must not otherwise reproduce, republish, distribute, adapt, frame, or commercially exploit any Content without our prior written consent. If you believe that any Content infringes your intellectual property rights, please contact us at contact@iet.com.sg with details of the alleged infringement.

12. Third-Party Links and Services

The Platform may contain links to third-party websites, applications or services, including government and regulatory websites. These are provided for convenience only. We do not control, endorse, or accept responsibility for the content, accuracy, availability, products, services or privacy practices of any third party, and your use of them is at your own risk and subject to their terms.

13. Distribution Through the Google Play Store

The Application is distributed through the Google Play Store. Your download and use of the Application is additionally subject to the Google Play Terms of Service and any other applicable Google policies. You acknowledge that these Terms are between you and IET only, and not with Google. Google is not a party to these Terms, is not responsible for the Application or its content, and has no obligation to provide any maintenance or support for the Application. Google is not liable for any claim relating to the Application, including product liability claims, claims that the Application fails to conform to any legal or regulatory requirement, or claims arising under consumer protection or similar legislation. You represent that you are not located in a country subject to an applicable government embargo, and that you are not on any applicable restricted-party list.

14. Availability, Updates and Changes to the Platform

We aim to keep the Platform available but do not guarantee uninterrupted or error-free access. The Platform may be unavailable due to maintenance, upgrades, technical faults, telecommunications failures or events beyond our control. We may modify, suspend, update or discontinue any part of the Platform, including any feature of the Application, at any time and without liability. Updates to the Application may be downloaded and installed automatically. Continued use of the Application may require you to accept and install updates.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Platform and all Content are provided on an "as is" and "as available" basis, without warranties or representations of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. Content on the Platform, including any reference to workplace safety, regulatory or manpower requirements, is provided for general information only. It does not constitute legal, regulatory, employment, financial or professional advice, and it should not be relied upon as a substitute for advice from a qualified professional or from the relevant authority. Regulatory requirements change; you should verify current requirements directly with the Ministry of Manpower or the relevant agency. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

16. Limitation of Liability

To the fullest extent permitted by law, IET, its directors, officers, employees, agents and subcontractors shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, business, goodwill, opportunity, anticipated savings, contracts or data, however arising and whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if advised of the possibility of such loss. Subject always to the preceding paragraph and to Section 15, our total aggregate liability arising out of or in connection with your use of the Platform shall not exceed [SGD 100] or the total amount you have paid to IET in respect of the Platform in the [12] months preceding the event giving rise to the claim, whichever is greater. Nothing in this Section limits any liability of IET under a separately executed Service Agreement with a Client, which shall be governed by the liability provisions of that agreement.

17. Indemnity

You agree to indemnify, defend and hold harmless IET and its directors, officers, employees and agents from and against all claims, demands, actions, proceedings, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Platform, your User Content, or your violation of any law or third-party right.

18. Suspension and Termination

We may suspend or terminate your access to the Platform, in whole or in part, immediately and without notice, if we reasonably believe that you have breached these Terms, that your use poses a risk to us or to other Users, or where required by law or by a regulator. You may stop using the Platform at any time and uninstall the Application. Termination does not affect any rights or liabilities that accrued before termination. Sections 9, 11, 15, 16, 17, 19, 20 and 21 survive termination.

19. Privacy and Data Protection

Our collection, use, disclosure and protection of personal data is described in our Privacy Policy, available at [https://www.iet.com.sg/privacy-policy/]. By using the Platform you acknowledge that you have read the Privacy Policy and consent to the handling of your personal data as described in it.

20. Changes to These Terms

We may amend these Terms from time to time. The revised Terms will be posted on the Platform with an updated "Last updated" date and take effect from the date of posting, unless a later date is stated. Where changes are material, we will take reasonable steps to notify you, for example by a notice on the Platform or by direct communication. Your continued use of the Platform after the revised Terms take effect constitutes your acceptance of them. If you do not agree to the revised Terms, you must stop using the Platform.

21. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the Republic of Singapore. The parties shall first seek to resolve any dispute amicably through good-faith discussions. If the dispute is not resolved within [30] days, the parties submit to the exclusive jurisdiction of the courts of the Republic of Singapore. [ALTERNATIVE: refer disputes to mediation at the Singapore Mediation Centre, or to arbitration administered by the Singapore International Arbitration Centre under its Rules, seated in Singapore, in the English language, before a sole arbitrator.]

22. General

  • Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and IET in relation to the Platform, and supersede all prior understandings on that subject.
  • If any provision is found to be invalid, illegal or unenforceable, the remaining provisions continue in full force and effect.
  • No waiver. Failure or delay by IET in exercising any right does not constitute a waiver of that right.
  • You may not assign or transfer your rights under these Terms without our prior written consent. IET may assign or transfer its rights and obligations to any affiliate or successor.
  • Third-party rights. Except as stated in Section 13 in respect of Google, a person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of these Terms.
  • Force majeure. IET is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, fire, flood, epidemic, pandemic, war, civil unrest, industrial action, government action, regulatory change, telecommunications or power failure, or cyber-attack.
  • These Terms are drafted in English. Any translation is provided for convenience only, and the English version prevails.
